PET CARE SERVICES AGREEMENT, WAIVER, AND RELEASE OF LIABILITY
This Pet Care Services Agreement, Waiver, and Release of Liability (“Agreement”) is between La Pawz Dog Care, located at 3000 Custer Rd #200, Plano, Texas 75075 (“Provider”), and the undersigned pet owner or authorized guardian (“Owner”).
This Agreement applies to each pet entrusted to Provider for boarding, daycare, grooming, or related services.
1. PERSONAL BELONGINGS
Owner understands that belongings left with a pet—including collars, leashes, bedding, toys, and containers—may become lost, damaged, or soiled. Provider is not responsible for the loss, damage, or condition of these items.
2. PET BEHAVIOR AND TEMPERAMENT
Provider may refuse or discontinue services, restrict group participation, or separate a pet from other animals if the pet displays aggressive, dangerous, or disruptive behavior toward animals or staff. Provider may also discontinue services if it determines that safe care cannot reasonably be provided.
3. BOARDING AND DAYCARE PICKUP
Provider’s lobby closes at 5:00 p.m., seven days a week. Owner must pick up the pet at the scheduled departure time unless other arrangements have been made in advance.
If Owner is late, Provider may, at its discretion, remain open for up to 30 minutes, at a charge of $1 per minute. If the pet is not picked up within that period, a $45 after-hours fee will apply, and pickup will be available when the facility next reopens.
4. GROOMING DROP-OFF AND PICKUP
Pets may be dropped off no more than 30 minutes before their scheduled grooming appointment. Owner must pick up the pet within one hour after receiving notice that grooming is complete.
Drop-off or pickup outside these timeframes will result in an additional $15 Spa Day Daycare fee.
5. ADDITIONAL BATHING OR CARE
If a pet requires additional bathing or care because of an accident or excessive soiling during a grooming visit, Owner agrees to pay the additional charges.
Provider recommends giving pets appropriate exercise and an opportunity to relieve themselves before check-in.
6. COMPLIMENTARY KENNEL BATH
Pets boarding for two or more consecutive nights receive one complimentary kennel bath before departure.
This service includes a basic bath and blow-dry. Full grooming and à la carte services are available for an additional charge.
7. VACCINATION REQUIREMENTS
Owner confirms that the pet is current on all vaccinations required by Provider, including Rabies, Bordetella, and Distemper/Parvovirus, and agrees to provide current written veterinary records.
Provider will not provide services without valid proof of rabies vaccination.
8. COMMUNICABLE ILLNESS
Owner understands that Bordetella and other communicable illnesses may spread in environments where multiple animals are present, even when pets are vaccinated.
Vaccination does not guarantee immunity. Owner acknowledges and accepts the inherent risk of exposure associated with boarding, daycare, grooming, and other shared animal environments.
9. FOOD AND DIGESTIVE ISSUES
Owner is encouraged to provide the pet’s regular food to help maintain its usual diet.
If Provider supplies food and the pet develops gastrointestinal distress requiring veterinary treatment, Owner agrees to pay the related veterinary costs and expenses.
10. DAMAGE CAUSED BY THE PET
Owner agrees to pay for damage the pet causes to Provider’s property, furnishings, or equipment, up to a maximum of $250 per pet.
11. FLEAS, TICKS, AND OTHER PARASITES
Owner confirms that the pet is free of fleas, ticks, and other parasites at check-in.
If fleas or ticks are discovered, Owner authorizes Provider to arrange or administer appropriate treatment at Owner’s expense. Treatment charges may be added to any scheduled grooming or other service charges.
12. LONG-TERM BOARDING
Boarding stays longer than two weeks require a written long-term boarding agreement and the required deposit.
A pet remaining in Provider’s care for more than three weeks without that agreement may be treated as potentially abandoned, subject to Section 13 and applicable law.
13. FAILURE TO RETRIEVE A PET AND ABANDONMENT
If Owner fails to pick up the pet at the agreed time and does not communicate alternative arrangements, Provider may treat the pet as potentially abandoned after 48 hours.
Before treating a pet as legally abandoned or transferring ownership or possession, Provider will comply with applicable legal requirements, including any required notice and waiting period. The timeframes in this Agreement do not replace those requirements.
Once legally permitted, Provider may surrender an abandoned pet to Animal Services, arrange adoption, or otherwise rehome the pet. Any relinquishment or transfer of Owner’s ownership rights is subject to applicable law.
14. ASSUMPTION OF RISK, WAIVER, AND RELEASE
OWNER UNDERSTANDS THAT BOARDING, DAYCARE, GROOMING, AND RELATED PET CARE SERVICES INVOLVE INHERENT RISKS, INCLUDING ILLNESS, INJURY, ESCAPE, AND DEATH. OWNER VOLUNTARILY ACCEPTS THESE RISKS.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, OWNER RELEASES AND DISCHARGES PROVIDER AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES FROM CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, AND LIABILITIES, WHETHER KNOWN OR UNKNOWN, ARISING FROM OR RELATED TO THE PET’S STAY OR THE SERVICES PROVIDED.
THIS AGREEMENT DOES NOT WAIVE ANY RIGHT OR LIABILITY THAT CANNOT LAWFULLY BE WAIVED.
15. SENIOR PETS AND PETS WITH HEALTH CONDITIONS
Owner understands that boarding, daycare, and grooming may cause stress, particularly for senior pets and pets with existing or undiagnosed health conditions. This stress may aggravate a condition and, in some circumstances, contribute to a serious medical event or death, even when reasonable care is provided.
Owner is responsible for determining whether the pet is healthy enough to receive the requested services and for disclosing known medical conditions, medications, physical limitations, and special care needs before services begin.
Owner acknowledges these additional risks and authorizes Provider to care for the pet with reasonable care, subject to the emergency medical authorization below.
16. EMERGENCY VETERINARY CARE
In an emergency, Owner authorizes Provider to obtain veterinary care for the pet at Owner’s expense, up to $500 without prior approval.
Treatment exceeding $500 requires Owner’s express approval. Owner agrees to pay all veterinary expenses authorized under this section.
17. PAYMENT AND COLLECTION
Owner agrees to pay all charges for services provided under this Agreement.
Unpaid balances are subject to a 15% late fee, to the extent permitted by law. Provider may refer unpaid amounts for collection or pursue legal action and may seek reasonable attorney’s fees and collection costs where permitted by law.
18. GOVERNING LAW AND VENUE
This Agreement is governed by the laws of the State of Texas. Venue for legal actions arising from or related to this Agreement will be exclusively in Collin County, Texas, to the extent permitted by law.
19. ENTIRE AGREEMENT AND FUTURE VISITS
This Agreement represents the entire understanding between Owner and Provider regarding its subject matter and replaces prior written or oral agreements concerning that subject matter.
This Agreement applies to the pet’s current stay and future visits unless revoked in writing.
